What Is the California Statute of Limitations for Motorcycle Accidents?
Personal Injury Lawsuits: The California Code of Civil Procedure section 335.1 states that individuals may file a personal injury lawsuit for their car accident up to 2 years following the date of their accident. If you attempt to file your lawsuit after the 2 years have lapsed, your case will most likely be thrown out.
Vehicle Damage Lawsuits: If you choose to file a lawsuit over property damage alone, rather than personal injury, California Civil Procedure 338 allows you to file a lawsuit for up to 3 years after the date of your accident.
Do You Have to Wear a Motorcycle Helmet in California?
The short answer is yes. All riders and passengers on a motorcycle must wear a helmet that meets the federal DOT standards. If you choose to ride without a helmet, which is illegal, you could face a fine of up to $250 and/or a year of probation. Plus, if you are injured in an accident while riding a motorcycle and you weren't wearing a helmet, you will have a much more difficult time getting compensation for your injuries. This is because motorcycle helmets help to protect you from head injuries while riding and if you chose to not wear one, you can be partially responsible for your injuries.
